Welcome to Surf Big Bay. These Terms and Conditions govern your booking and participation in surf lessons, rentals, and related activities provided by Surf Big Bay ("we," "us," or "our") in Big Bay, Cape Town, South Africa. By booking a lesson or using our website, you agree to comply with and be bound by these terms.

1. Bookings and Payments

  • All booking requests made via the website are subject to availability and confirmation.
  • All prices listed on our website are in South African Rand (ZAR).
  • Full payment is required upfront to secure and confirm your booking slot.
  • Payments are processed securely online through our integrated payment partner, Yoco. We do not store or have access to your credit or debit card details.

2. Cancellation and Rescheduling Policy

2.1 Cancellations by the Customer

  • Cancellations made more than 24 hours prior to the scheduled lesson time will be eligible for a full refund or a flexible reschedule date.
  • Cancellations made less than 24 hours before the scheduled lesson time, or failure to arrive for a lesson ("no-show"), will forfeit the full lesson fee.

2.2 Cancellations by Surf Big Bay (Weather & Safety)

  • Surfing is entirely dependent on ocean and weather conditions. For safety reasons, we reserve the right to cancel or postpone lessons due to adverse weather, dangerous surf conditions, extreme wind, or marine hazards.
  • If a lesson is canceled by us due to weather or safety concerns, you will be notified as early as possible and offered the choice of a flexible reschedule slot or a full refund.

3. Participation, Health, and Safety Requirements

  • Swimming Ability: All participants must be water-confident and able to swim competently in open ocean conditions.
  • Age Restrictions: Children under a specific age threshold must be disclosed at booking and may require private 1-on-1 instruction for safety reasons.
  • Medical Conditions: You must disclose any pre-existing medical conditions, injuries, physical limitations, or allergies that may affect your safety in the water before the lesson begins.
  • Substance Policy: We reserve the right to refuse instruction to any participant who appears to be under the influence of alcohol, drugs, or any substance that impairs judgment or physical capability. No refunds will be issued in such instances.

4. Inherent Risks and Indemnity Waiver

  • By participating in a surf lesson, you acknowledge that surfing is an inherently strenuous and hazardous outdoor activity taking place in an unpredictable natural ocean environment.
  • Risks include, but are not limited to, physical exertion, collisions with surfboards, contact with the seabed, marine life encounters, and varying ocean currents.
  • You agree to follow all safety instructions provided by your designated surf coach at all times.
  • To the maximum extent permitted by South African law, Surf Big Bay, its owners, instructors, and employees shall not be held liable for any personal injury, loss, death, or damage to personal property sustained during, or arising from, participation in our activities. You will be required to sign a standard physical or digital liability waiver prior to entering the water.

5. Equipment Use and Damage

  • Surf Big Bay provides surfboards and wetsuits as part of the lesson fee unless specified otherwise.
  • Participants are responsible for treating all provided equipment with reasonable care.
  • We reserve the right to charge the customer for the repair or replacement cost of any equipment that is lost, stolen, or severely damaged due to gross negligence or willful misuse.

6. Media and Photography Release

  • During lessons, photography or videography may be captured by our staff or professional partners for marketing, social media, and promotional activities.
  • If you or your minor child do not wish to be photographed or featured in promotional materials, you must explicitly notify us before the lesson commences.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts.
